الملخص

تعد الغرامة من أقدم العقوبات التي عرفتها البشرية، حيث تمتد حدودها إلى نظام الديات التي عرفته الشرائع القديمة وهو نظام التعويض العقابي، إلاّ أنها تجردت في العصر الحديث من كل معاني التعويض لتصبح جزاء جنائي صرف يحمل معنى الإيلام متمثلاً في الذمة المالية للمحكوم عليه، لذلك سوف نبين من خلال ما سيتم استعراضه لاحقاً ماهية الغرامة وطبيعتها الجنائية ووظيفتها العقابية، والتنظيم القانوني لها المتمثل في آلية تنفيذها والمرونة العقابية.
