The temporal scope of jurisdiction in criminal law raises numerous questions and issues during its application. The jurisdiction of the International Criminal Court (ICC) over the Libyan situation since the adoption of Security Council Resolution 1970 of 2011 is no exception. Some legal scholars have addressed this issue, objecting to the continued application of the ICC's jurisdiction over the Libyan situation, even extending to events that occurred after the Security Council resolution, and indeed, even to events that occurred after the end of the Libyan revolution.
Therefore, this paper examines the temporal scope of the ICC's jurisdiction over the Libyan situation, highlighting the main objections to the continued application of the ICC's jurisdiction. It also explores the relationship between the Security Council and the ICC, concluding with the opinion of the ICC chambers on this matter. The paper is divided into two sections: the first addresses the relationship between the ICC and the UN Security Council. The second section is dedicated to the opinion adopted by the International Criminal Court regarding the scope of its temporal jurisdiction in the Libyan situation.
