Legal guarantees for collecting social security contributions in Libyan legislation

Abstract

This research examines the legal guarantees for collecting social security contributions under Libyan legislation. The study addresses the problem of evasion from paying these contributions and its negative impact on the financial system of the Social Security Fund. The researcher analyzes two types of guarantees provided by the legislator: civil guarantees, such as delay fines, administrative seizure, lien rights, successor liability, and withholding administrative licenses; and criminal guarantees, which include penalties for failing to register or obstructing the contribution process. The paper concludes that while these legal tools aim to ensure financial sustainability and protect workers' rights, there is a need to develop supervisory mechanisms to enhance their effectiveness.
