The Doubt That Nullifies Hudud Punishments: A Comparative Jurisprudential Study

Abstract

Praise be to God alone, and prayers and peace be upon the one after whom there is no prophet. The study of the legal limits and the effect of doubts in suspending them is a subject of great benefit, as it is related to achieving justice and mercy in the application of punishments. It aims to know that the purpose of legislating punishments in Islamic law does not lie in revenge and vindictiveness, and that mercy and justice are the basis of Islamic law, and to explain the concept of doubt and its types in Islamic jurisprudence. And to highlight the facts for which Islamic law came, and the great objectives that the pure law took into account, and which certainly among its greatest objectives is the preservation of life and the prevention of injustice, as well as the presentation of the precautionary aspect in bloodshed, to prevent the error of taking lives without verification and clarification.
